2019年1月USPTO同時發布兩則guidance,除了101,112也是OA常客。今年這篇就是針對電腦相關發明的112審查指引。
這篇的Part I先談關於落入112(f)解釋以及相關的112(b)。
Part II則是談112(a)的enablement requirement。
Part I: 112(f) 與 112(b)
在審查電腦軟體相關專利時,應先判定是否會invoke 112(f)的means-plus-function解釋。需先釐清的是,以112(f)的means-plus-function解釋claim,不代表有違反專利法。以112(f)解釋僅是表示claim的範圍,是對應說明書所揭露的structural, material or act及其均等物。
亦即,在OA中審委有表示以112(f)解釋,申請人若是認同,可以選擇不針對此處進行申復。而若是申請人不希望以112(f)解釋,則可以選擇 (1)提供證據說明claim記載足夠結構,不應以112(f)解釋; 或 (2)修改claim以避免落入112(f)。
根據法院目前的判例見解,在claim中使用means,會先推定invoke 112(f),但仍會進一步判斷。但相反的,若是沒有使用means,則不能直接推定不會invoke 112(f),也就是說,從申請人的角度,不能直接說claim沒有記載means就不會invoke 112(f)。
具體來說,審查委員應先決定claim的BRI (broadest reasonable interpretation),參考說明書以及該領域通常知識者水平。接著根據MPEP 2181記載的審查3步驟,決定是否invoke 112(f)。
(A) the claim limitation uses the term “
means” or “
step” or a term used as a substitute for “means” that is a
generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function;
(B) the term “means” or “step” or the generic placeholder
is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as "configured to" or "so that"; and
(C) the term “means” or “step” or the generic placeholder
is not modified by sufficient structure, material, or acts for performing the claimed function.
